TitlePractice Area : Insurance
For nearly a century, the attorneys of Meserve, Mumper & Hughes LLP have been recognized as national experts in providing legal representation to the insurance industry. The Firm specializes in insurance litigation relating to individual and group life, health and disability claims, ERISA and coverage disputes in general. As a result of such expertise, the Firm regularly represents carriers in first party bad faith actions, contractual disputes, ERISA matters and fraud and abuse recoveries throughout California. In addition, the recent expansion of the managed care business has led to the our growing involvement in litigating and advising clients on developing issues in this new and evolving industry.

We have also gained national recognition for our work in matters involving business and property insurance. In this specialty area of law, clients primarily include insurance carriers seeking legal advice and representation in litigation concerning significant claims and exposures.

In many instances, the Firms attorneys assist in the evaluation of client insurance needs of clients before losses occur or litigation is asserted. Should a client become a defendant in business litigation, the Firm identifies and pursues coverage through a variety of appropriate policies. Counsel is provided in evaluating coverage obligations under such policies as comprehensive general liability, fire and multi-peril, business interruption, marine and aircraft insurance, and employers liability, among others. The Firm has also defended numerous insurers against claims of wrongful denial of coverage for these types of claims.

The experience we bring to this practice area includes negotiating and enforcing various agreements pertaining to self-insured retentions, minimum premium arrangements, captive insurance and reinsurance programs, multiple employer trusts, group and assiciation agreements, and similar agreements.
